Latest from the High Court – The hearing into the legitimacy of the planning approval granted by Cornwall Council to application PA20/03747 ended up running into two days and was concluded at lunchtime today, 25th February. Judicial reviews can only be about the process through which a decision was reached, rather than the merits or otherwise of the application, so the discussion over the last two days has been about the extent to which councillors have to give reasons for their decisions and the whether they are required to refer to policy frameworks when making their decision.
The judge will now make her deliberations and indicates that she will hand down a judgment around Easter.
